Below are the terms and conditions of contracting emmarie Web Design for your web and graphic solutions that you must agree upon in order for work to continue on your project. There will be a place at checkout confirming that you have read, understand and agree to these terms and conditions. RETURNS & EXCHANGES
Due to the nature of my work, I do not extend returns or exchanges for my work, whether it has already been completed, or has yet to be completed. When you purchase a design or maintenance package, you will receive what items or time that you purchased. If you do not want a project to be completed, you forfeit your payment.
WARRANTIES
emmarie Web Design and its components, including but not limited to, any advertising are provided on an "as-is" basis without any warranties, express or implied. emmarie Web Design does not offer any warranty that any part of the site will be completely secure and unchanging. Users use this site at their own risk.
TIMELINES
Timelines given for any project not under contract are estimates and can change due to an incalculable number of factors. I will do my work as quickly as possible. In the event that a timeline is stalled due to a client not meeting their deadline for getting content or processing edits for over 30 days, a project will be terminated and no refund will be issued. Additional design time will need to be purchased to complete the project after this time.
MAINTENANCE
Maintenance refers to any request requiring me to work on any aspect of your website, branding or print products that have already been designed/implemented. The design/implementation of new elements will require the fees and scheduling policy of design hours.
Maintenance requests requiring more than 2 hours (5-10 tasks, depending) will require booking on my project calendar. This can put your maintenance out up to a month or more, so if you have a large amount of maintenance, book early.
Small amounts of maintenance (requests requiring 5 minutes to 2 hours) will be done by request on Mondays. If my maintenance availability is booked on any given Monday, your maintenance will be booked on the next available Monday. Monday slots, as with project calendars slots, are first-come/first-serve.
In the event that your maintenance is more pressing and you wish for your maintenance to be "rushed" for the closest Monday to your request, a $50* rush fee will need to be paid at the time of booking for small maintenance, and $100* for large maintenance (limit of 4 hours).
If your maintenance is required IMMEDIATELY, a $100* rush fee will need to be paid at the time of booking for maintenance that takes under 2 hours, and $300* if it will require more than 2 hours.

*Maintenance rush fees are in addition to regular maintenance hours that are pre-purchased. Maintenance rush fees may change at any time and without notification.
Maintenance plans expire one year from the date of purchase.
PAYMENT PLANSI do offer a 50/50 payment plan on large design projects (those exceeding $2000). Fifty percent of the package total will be due to hold a place on the project calendar, with the remaining fifty percent due a minimum of three days before the project begins.
No design payment will exceed 90 days. If a project is not paid for within 90 days, a fee of 20% of the remaining total will be added each 14 days there is a remaining balance. If you would rather discontinue payment, you forfeit any money that you have already paid. Packages/products/services paid for via a payment plan will not be given refunds if you decide to discontinue further payment.
LIMITATIONS OF LIABILITY
emmarie Web Design is not liable to you in relation to the content, use of, or in connection with this website. Nor are we responsible for the success, or lack thereof, of any product we create for our customers and their business. By using this website and it's services, you agree to these limitations of liability.
COPYRIGHTS
emmarie Web Design retains rights to all content, images, and coding on this website and any other website directly related (i.e. emmarie Designs Blog). A violation of these rights, which includes but is not limited to, copying, hacking or otherwise using without prior consent, will result in legal action.
emmarie Web Design retains rights to all coding of sites created for our customers and their businesses, unless a release of copyright has been arranged. Unauthorized copying and/or altering of the code can and will result in legal action.
DESIGN COPYRIGHTS
Designer retains rights to all coding of sites created for our customers and their businesses, unless a release of copyright has been arranged.
DESIGN CREDIT
Unless otherwise agreed, Designer shall be accorded a credit line on all website pages, to read as follows: Website Designed by emmarie. Credit line will include an outgoing link to http://www.emmariewebdesign.com.
DESIGN ADDITIONAL USAGE
If Client wishes to make any additional uses, Client shall seek permission from the Designer and pay an additional fee to be agreed upon.
AGREEMENT
By checking that you have "read, understand and comply" to the terms and conditions of emmarie Web Design products and services upon checkout, you agree to abide by these conditions, without retract. Any other use of this site also implies that you have read, understand and comply with these terms and conditions.
